No plans to regularise Sainik Farms: Centre to HC

New Delhi, The Centre has told the Delhi High Court that it has no plans to regularise the Capital’s controversial Sainik Farms.
It can be done only after the Master Plan 2021 is notified, the Centre added.
A bench headed by Chief Justice A P Shah directed the Centre and the Delhi government to inform the court by April 8, the status of the Master Plan 2021, which is awaiting clearance from the Cabinet.
Counsel for the government told the court yesterday that the Master Plan 2021 has been finalised after all objections were cleared on June 13, last year. It is awaiting to be notified.
The colony, which is home to the Capital’s rich and powerful, is looking forward to get its “unauthorised colony” status changed to an authorised legal colony, but the Delhi and Central governments have no plans to grant it any legitimacy at present.
The Delhi government lawyer told the Court that a draft of the Master Plan 2021 has been prepared and is pending for the approval. Only after the plan gets notified, the status of all the colonies will be clear, he said.
The Lawyer from the Centre said Sainik farms has been kept in a category, whereby it can be regularised, but with a higher price. The formula for levelling the charges could be 50 per cent over and above the price of the land at the existing market rate and penalty for violating land laws for those buildings, which have violated the building plans.
Replying to the query of lawyer Rajive Awasthi whether Sainik Farms is an authorised colony or not, the government’s lawyer clearly stated, ”As of now, Sainik Farms is an unauthorised colony.” This controversial area has been seen as a clear violation of land and revenue laws, along with Master Plan of Delhi’s provisions by the Justice Nanavati Commission’s report, which had recommended that not only land price should be recovered from the illegal owners while legalising, but also a penalty should be imposed so that it acts as a deterrent for the land mafia.
The land, in case of Sainik Farms was given to ex-service personnel for farming, which was then converted into palatial residential bungalows. The farmhouses were then sold to the city’s high and mighty, who own them now, and have created their own roads, power supply, water reservoirs on the agricultural land.
Two more colonies, Anant Ram dairy in south Delhi and Mahendru Enclave in north, will also be regularized using the same formula,of extra charges and penalties as they too are colonies on private and government land, the government lawyer told the court.
The Court fixed April 8 the next date of hearing and directed the Delhi government to inform the status of the Master Plan 2021, whether it has been notified or not.
